These are our General Terms and Conditions. These General Terms and Conditions always apply when you use or place an order through the website located at www.atelierbossier.be. These General Terms and Conditions contain important information for you as a user of the website. Please read them carefully. We also recommend that you save or print these General Terms and Conditions so that you can consult them later when needed.
Article 1: Definitions
‘HUNA BVBA’: based in Heusden-Zolder (Belgium) and registered with the commercial register. Atelier Bossier is a brand name of HUNA BVBA.
‘Website’: the website located at www.atelierbossier.be and all of its subdomains.
‘Client’: the natural person or corporation acting in the performance of a profession or business who enters into an agreement with HUNA BVBA and/or who registers on the website.
‘Agreement’: any agreement or agreement between HUNA BVBA and the client of which the
General Terms and Conditions are an integral part. ‘General Terms and Conditions’: there General Terms and Conditions, listed below.
Article 2: Applicability of the General Terms and Conditions
2.1 The General Terms and Conditions apply to all offers, agreements and deliveries of HUNA BVBA, unless otherwise explicitly agreed to in writing.
2.2 If the Client in his order, confirmation or any other communication alleging acceptance of the General Terms and Conditions includes any provisions that differ from, or are not in included the General Terms and Conditions, such provisions will only be binding upon HUNA BVBA if and in so far as HUNA BVBA has explicitly accepted them in writing.
Article 3: Prices and Information
3.1 All prices indicated on the Website originating from HUNA BVBA include taxes and other levies imposed by the government, unless stated otherwise on the Website.
3.2 If shipping costs are charged, these will be clearly stated before the contract is concluded. These costs will also be displayed separately in the ordering process. An order above €150;- will enjoy free shipping.
3.3 The content of the Website is composed with the greatest care. HUNA BVBA cannot, however, guarantee that all information on the Website is correct and complete at all times. All prices and other information posted on the Website and in other materials originating from HUNA BVBA are subject to correcting typographical and/or programming errors.
3.4 HUNA BVBA cannot be held responsible for deviations in color that result from the quality of the colors displayed on the screen.
Article 4: Conclusion of the Agreement
4.1 The Agreement will be deemed to be concluded at the moment the Client accepts the offer of HUNA BVBA subject to the conditions stipulated by HUNA BVBA.
4.2 If the Client has accepted the offer by electronic means, HUNA BVBA will confirm receipt of acceptance of the offer by electronic means without delay. Until such receipt of acceptance is confirmed, the Client will have the possibility to dissolve the Agreement.
4.3 HUNA BVBA has the right to refuse orders from Clients who do not act in the exercise of their profession or business.
Article 5: Execution of the Agreement
5.1 As soon as HUNA BVBA has received a Client’s order, it will send the products to the Client without delay and with due regard for the provisions of Article 3 of this article.
5.2 Orders placed between Monday and Friday, before 11 A.M will begin processing that day, excluding holidays. The shipment will endure 3 to 4 business days pending availability and credit verification. All orders placed after 11 A.M will begin processing the next business day. Orders placed on Friday after 11 A.M will begin processing on the following Monday.
5.3 Delivery time does not include Saturdays, Sundays or Holidays.
5.4 If HUNA BVBA is unable to deliver the products within the agreed term, it will notify the Client accordingly. In such event, the Client can decide either to agree to a new delivery date or to dissolve the Agreement without incurring any costs.
5.5 HUNA BVBA advises the Client to inspect the products upon receipt and to report any defects within 2 working days after delivery in writing or by email. When damaged, photographic evidence must been taken and sent to email@example.com, in order to find the best solution for the Client. The costs of shipment for the return will be compensated by HUNA BVBA, when the error is made by us. In that case we provide a pre-paid shipping label for your convenience.
5.6 Items bought online cannot be refunded or exchanged in stores which sell our products.
Article 6: Returns
6.1 We accept returns and exchanges on goods returned to HUNA BVBA within 14 days, starting from the date of purchase.
6.2 The Client will be responsible for paying the shipping costs in case of returning an item. Shipping costs are non-refundable, unless damaged goods.
6.3 Returns attempted after the fourteen (14) day period, or attempted without our satisfying all of the above conditions, will not be accepted. The Client must bear the costs for shipping the goods to HUNA BVBA.
6.4 An item can be returned for a full refund or exchange if it meets all of the following criteria:
- All items must be returned in original condition. This means that the items are unused, unworn, unwashed, unaltered and undamaged.
- All items must be returned in their original packaging.
- All the tags must be still attached.
6.5 HUNA BVBA is not responsible for any returns which are lost in the mail when being returned to us. We advise you to insure your package containing the product(s) being sent to us and get tracking information. No exceptions can be made to this policy.
6.6 Shipping and Handling charges for the returned merchandise will be refunded if we have made an error. Otherwise they are non-refundable.
6.7 Items marked as “sale” will not be refunded, but can always be exchanged for the same article, in a different size.
6.8 Personalised items can not be returned nor refunded.
Article 7: Exchanges
7.1 Exchanges follow the same policies and procedures as returns; please refer to the above mentioned Terms and Conditions to determine if an item is eligible for exchange.
7.2 If we have made a mistake in our fulfillment, we will, of course, exchange the item and cover the new shipping charges.
Article 8: Refunds
8.1 Once we receive the Client’s item, we will inspect it and notify the Client that we have received the returned item. We will immediately notify on the status of the refund after inspecting the item. If the Client’s return is approved, we will initiate a refund to the original method of payment. the Client will receive the credit within a certain amount of days, depending on your card issuer’s policies.
8.2 HUNA BVBA will refund items in the following cases:
- The costs of shipment for the return of damaged pieces.
- Damaged pieces (if there is no form of exchange)
- Returns (if there is no form of exchange)
8.3 The Client will be responsible for paying the shipping costs in case of returning an item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.
Article 9: How To Return or Exchange an Item
9.1 In an effort to make returns and exchanges as easy as possible, we request the following procedure:
- Make sure the items you are returning or exchanging comply with our Return Policy Terms and Conditions.
- The Client sends an email to firstname.lastname@example.org including order number, name, phone number, e-mail address and the reason for return.
- Please ship the securely packaged merchandise to the HQ of HUNA BVBA: De Lange Beemden 21, 3550 Heusden-Zolder, Limburg, België.
- Please note that HUNA BVBA does not accept responsibility for packages we do not ship (and therefore cannot be responsible for packages lost in transit).
Article 10: Payment
10.1 The Client shall pay the amounts due to HUNA BVBA in accordance with the ordering procedure and any payment methods indicated on the Website. HUNA BVBA is free to offer any payment method of its choice and may change these methods at any time.
Article 11: Final Provisions
11.1 These General Terms and Conditions are governed by the laws of Belgium.
11.2 Any disputes arising pursuant to these General Terms and Conditions will be submitted to the competent Belgian court in the district where HUNA BVBA has its registered office.
11.3 If any provision of these General Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such invalidity or unenforceability shall not impair, affect or render invalid or unenforceable any other provision of these General Terms and Conditions, and such invalid or unenforceable provision shall be replaced by a provision that is valid and en forceable and that comes closest to expressing the intention of such invalid or unenforceable provision.
11.4 The content of the Website (included of brands, logo, sketches, data, product- and company names, texts, images, etc.) will be protected by the law of Intellectual property, in which they belong to HUNA BVBA.
Article 12: Liability
12.1 The information on the Website is of common nature, which implies that the information is not adapted to personal or specific circumstances. The information cannot be considered as a personal, professional nor legal advice to any Client.
12.2 The content of the Website is composed with the greatest care. HUNA BVBA cannot, however, guarantee that all information on the Website is correct and complete at all times. All information posted on the Website and in other materials originating from HUNA BVBA are subject to correcting typographical and/or programming errors.
12.3 HUNA BVBA cannot be hold liable in case of direct or indirect blemish by the used information on the Website. In case of inaccuracy of information, please do contact the company.
